§ 66-161. Definitions.

  • The following terms, as used in this article, shall have the following meanings unless the context thereof indicates to the contrary.

    Access means entrance to or exit from land adjacent to a public road.

    Accessible frontage means that length of property adjoining a highway which is legally accessible horn the highway. Frontage along a limited access highway shall not be included as part of the nearest travel lane to the centerline of the driveway. An angle of 90 degrees is desirable.

    Angle of an entrance driveway means the angle of deflection measured horn the centerline of an "ENTER ONLY" driveway to the centerline of the nearest travel lane. This angle should never exceed 90 degrees.

    Angle of an exit driveway means the angle of deflection measured horn the centerline of an "EXIT ONLY" driveway to the centerline of the nearest travel lane. This angle should never exceed 90 degrees.

    Applicant means the person or organization who has applied for a permit. This should be the property owner or owners, official representative of the organization (company, partnership, etc.) which owns the property or is leasing it for at least three years. A copy of the deed or lease will be required as part of the application process.

    Commercial driveway means any private entrance, exit, ramp, tunnel, bridge, side road or other vehicular passageway to any property used for commercial purposes, except a farm or dwelling house not exceeding a four-family capacity, and leading to or horn any public road on the city highway system.

    Department means the city building inspection department.

    DOT means the state department of transportation.

    Driveway width means the narrowest width of a driveway measured perpendicular to the centerline of the driveway, from edge of pavement to edge of pavement.

    Encroachment means use of a city right-of-way by anyone other than city personnel or authorized agents for any specific purpose other than that generally intended.

    Frontage means the length of property adjoining a highway.

    M.U.T.C.D. means the Manual on Uniform Traffic Control Devices.

    Noncommercial driveway means a driveway serving a school, government building, church, hospital or other noncommercial organization inviting public use.

    Permit means a legal document issued by the city authorizing an applicant to do specific work on the right-of-way.

    Physical modification means the physical modification of a city road in any manner including, but not limited to, the placement or removal of dirt, fill, or other material upon or from a city road; the connecting or removal of a private driveway to a city road; the installation or removal of culverts, pipes, and other drainage apparatus upon or from a city road; the ditching or contouring of any portion of a city road; and the installation, construction, maintenance, removal and relocation of pipes, mains, conduits, cable, wires, poles, towers, traffic signals, and other equipment, facilities and appliances in, on, along, over, or under a city road.

    Residential driveway means any private passageway to any property used for a dwelling house not exceeding a capacity of four families.

    Right-of-way (R/W) means all land under the jurisdiction of and whose use as a city road is controlled by the city.

    Right-of-way line means a line which defines the limits of the R/W of a public road as it relates to adjacent property.

    Right-of-way miter means a R/W line at an intersection which is parallel to neither road but forms a triangle with extensions of the R/W lines of the adjacent sides of the intersecting roads. The purpose of the R/W miter is to provide improved visibility for vehicles approaching the intersection by enabling the city to eliminate visual obstructions or provide room for a traffic light support pole or guy wire. Driveway should never be allowed along the R/W miter.

    Roadway means the portion of a highway ordinarily used for vehicular travel, exclusive of the sidewalk, shoulder or median.

    Sight distance means the length of roadway ahead visible to the driver. The minimum sight distance available on a roadway should be sufficiently long to enable a vehicle traveling at or near the design speed to stop before reaching a stationary object in its path.

    Third party means any utility, person, corporation, partnership, authority, agency or other legal entity other than the city.

    Utility means any publicly, privately, or cooperatively owned line, facility, or system for producing, transmitting, or distributing communications, power, electricity, light, heat, gas, oil products, water, steam, waste, stormwater not connected with highway drainage, and other similar services and commodities. This term also means a person, municipal corporation, county, state agency, or public authority which owns or manages a utility.
