§ 66-201. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Administrative coordinator means the mayor, who shall be the administrator for the receipt and processing of applications for a permit for a private organization or group of private persons to hold a parade, assembly, demonstration, road closing, or other use of public property and roads for private purposes. The mayor may be assisted by other employees of the city.

    Event as used in this article, means any activity which affects the ordinary use of parks, public streets, public facilities, rights-of-way, sidewalks, and/or disrupts the flow of traffic upon public streets or sidewalks. Normally events are activities held upon public property for private use; however, an activity held upon private property which, by size or nature, negatively affects the normal use of public property so as to interrupt the use of streets or sidewalks by the general public OR interrupts the normal delivery of service of public safety resources inside the city shall be an event.

    Licensee means a person and/or business issued a current alcohol license by the City of Ellijay.

    Parades, etc., do not include funeral or wedding processions unless such events require law enforcement services which exceed usual and normal costs.

    Private organization or group of private persons means any firm, partnership, corporation, association or organized group of individuals more than 15 in number, acting as a unit.

    Private purpose means any purpose not commanded or directed by statute, ordinance or other regulation to be performed by the state, county or other governmental entity.

    Proper alcohol license is the possession of the licenses through both the City of Ellijay and the State of Georgia for the sale and/or distribution of alcoholic beverages within the city.

    Special event is an event within the incorporated boundaries of the City of Ellijay whereby alcohol will be provided or sold for monetary exchange and the location of which does not otherwise hold the proper alcohol license through the city.

    Special event permit is a temporary alcohol license issued by the City of Ellijay for a period not to exceed three days, unless otherwise specified, which is required prior to the provision of alcohol tied to any monetary exchange or transfer of funds at a location which is not otherwise properly licensed for the provision or sell of alcohol.
